Introduction

Triad ICC, LLC (“Triad ICC” or “we” or “us”) has created this Privacy Policy in order to disclose its collection, use and disclosure of personally identifiable information and associated data collected about you. If you use a website, mobile app, social networking site, or a service displaying or referencing this Privacy Policy, you consent and agree to this policy and the collection, use and sharing of your personal information as described herein and in accordance with the applicable agreements, including any applicable terms of service and/or end-user license agreement.

IF YOU PROVIDE INFORMATION TO Triad ICC about a student on behalf of the student, you represent and warrant to be the parent or legal guardian of the student and also give your consent and agree to the foregoing on behalf of the student.

Some businesses may choose to engage Triad ICC as a “data processor” for certain services and in such case the collection, use and sharing of personal information for the engagement may be governed by the agreement between Triad ICC and our customer, and the customer’s privacy policy, in addition to or in lieu of this Privacy Policy.

We may update this Privacy Policy from time to time, as described below. You are responsible for reviewing this policy from time to time with respect to updates, revisions, or modifications to this Privacy Policy.

Personal Information Collected and Received

Triad ICC may collect or receive information about each person who visits or registers with the Triad ICC website, services and/or applications including, but not limited to, username, password, first and last name, email address, street address, gender, and interests. Triad ICC also collects other information, including, but not limited to the date and time of your visit, the website that referred you to Triad ICC, pages you access, your geographic region / zip code, and other information you may volunteer.

We may collect personal information from you at various points, including but not limited to:

  • when we correspond with you;
  • when you visit the website and/or associated services;
  • when you register as an end-user of our services and an account is created for you;
  • when you provide information, such as user contributed content, survey information or join our mailing list;
  • when you engage with us or our users and other visitors on publicly accessible blogs, community forums, and social media;
  • when you contact us for help;
  • when information is collected through cookies, beacons and similar technologies;
  • when the website and/or associated services sends us error reports or collects certain analytics data; and
  • when engaged by a customer to perform services for them or on their behalf.

Triad ICC does not require you to include sensitive information (e.g. racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic data, biometric data, data concerning health or data concerning sexual orientation). In the event that you provide such sensitive information without an express agreement covering it, you acknowledge that you have provided explicit consent concerning the collection, use and disclosure of such information.

Some personal information may also be collected by a third-party as a service provider or other vendor. If you interact with some third-party services, such as social media companies, particularly where you have an account with the third party, they may collect additional information separate from Triad ICC.

Use and Disclosure of Personal Information

Triad ICC may use and share personal information that we collect or receive about you to:

  • deliver the products and services that you have requested;
  • manage your customer relationship and provide you with information or customer support;
  • administer a sweepstakes, contest or similar promotion you enter;
  • perform analysis about your use of the website and/or associated services;
  • communicate with you by e-mail, postal mail, telephone and/or mobile devices about products or services that may be of interest to you;
  • administer a publicly accessible blog, community forum or social media site, when you visit or participate in it;
  • enforce our terms and conditions and other agreements;
  • perform services as a processor on behalf of a customer;
  • manage our business, including testing, development and other functions as part of improving and expanding the services offered;
  • conduct a sale of all or substantially all of our business or assets, which includes the sale, assignment or other transfer of your personal information in connection with such transaction.
  • respond to investigation, court orders, legal process, or to investigate, prevent or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person, or as otherwise required by law; and
  • perform functions as otherwise described to you at the time of collection.

Except as described in this Privacy Policy, we will not disclose your personal information to any third party without notifying you of our intent to share the information and giving you an opportunity to prevent your information from being shared.

From time to time, we may share information with companies and organizations based on the interests of our users, including but not limited to as follows:

  • We may share aggregate statistical and demographic information about our website’s visitors with our marketing providers;
  • We may share your information with scholarship providers and organizations in accordance with your direction; and
  • We may share information as otherwise described in this Privacy Policy.

Triad ICC reserves the right to disclose information when required by law.

We use other companies to perform services necessary to our operations. In the course of providing these services, those companies may have access to your personal information. By contractual agreement, those companies must treat your information in accordance with this Privacy Policy. However, we will not be liable for any damages that may result from the misuse of your personal information by these companies.

Triad ICC may use your IP address to help diagnose problems with Triad ICC’s server and to administer Triad ICC’s web site. Your IP address may also be used to help identify you and your online profile and to gather broad demographic information.

The Triad ICC site registration form requires users to give Triad ICC contact information (such as your name and email address) and demographic information (such as your zip code, age, or income level). Triad ICC may use your contact information from the registration form to send you information about Triad ICC and promotional material from some of Triad ICC’s partners. Your contact information may also be used to contact you when necessary. Triad ICC may use demographic and/or profile data to tailor your experience on the Triad ICC website and/or applications, show you content that Triad ICC thinks you may be interested in, and display content according to your preferences. Furthermore, Triad ICC shall have the right to retain records of all data pertaining to use of the website and applications including, but not limited to, usage, activity logs, and click-throughs.

We may also disclose, on an anonymous basis, statements made by our users about Triad ICC. With your consent, we may also post your name and photograph along with your testimonial.

Access, Correction, Deletion and Account Termination

You may have the right under the law to request access to the information that we have on you. In order to comply with your request, we may have to verify your identity. If you believe that the information that we have about you is incorrect, please contact us with a change request. You also may have the right under the law to request the deletion of your personal data. If we are operating as a processor for our customer with respect to your personal data, we will redirect your inquiry to the customer as appropriate. Users of Triad ICC who wish to terminate their membership, or otherwise request to cease usage of their information at Triad ICC may do so at any time by contacting us via our contact form. Please be sure to type “Remove” in the subject field and submit the email account associated with the membership you would like terminated. We will respond to your request within a reasonable timeframe. Information will be retained for as long as the account is active or requests our services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

California Consumer Privacy Act (CCPA)

The California Consumer Privacy Act (CCPA) offers California residents the right to opt-out of the sale of their personal information. Triad ICC shares your information in certain cases with a variety of third-party entities as part of the services, since it allows you to interact with scholarship providers and also participate in college and university recruiting along with get information from others related to the college admissions and financial aid process. When you opt to interact with these third-parties, our website passes your information along to them so that they are able to provide more information to you about their scholarship, financial aid, institutional and other programs and offerings.

On occasion, Triad ICC may also provide your personal information to advertisers and other marketing partners who are interested in marketing to your specific demographic in exchange for fees or other consideration. If you do not want us to sell your information as defined by CCPA, we encourage you to opt-out of such sales of your information. Also, if you are a California resident under 16 years of age, we will not sell your information as defined by CCPA unless you opt-in at the time you create an account or at another time that you choose to allow us to sell your information. If you direct us to provide personal information to a third party, the provision of that information is not considered a “sale” under the CCPA.

Your California Privacy Rights

In addition to rights that may be described elsewhere:

If you are a California resident, California Civil Code Section 1798.83 permits you to request certain information regarding our disclosure of personal information to third parties for the third parties’ direct marketing purposes. To make such a request, please contact us by sending an e-mail to privacy@imaginescholarships.com.

If you are a California resident under the age of 18, and a registered user of our website and/or application, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please send an e-mail with a detailed description of the specific content or information to privacy@imaginescholarships.com. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

Under California law, California residents who have an established business relationship with us may opt-out of our disclosing personal information about them to third parties for their marketing purposes.

Children’s Privacy

We do not knowingly collect any information from anyone who we know to be under the age of 13. Children under the age of 13 are not allowed to register with Triad ICC. If you are under the age of 18, you should use this website only with the involvement of a parent or guardian. If we discover that a person under the age of 13 has provided us with any personal information, we will use commercially reasonable efforts to delete such person’s personal information from all Triad ICC systems.

Security

Triad ICC uses industry-standard technologies when transferring and receiving consumer data to help ensure its security. This site also has security measures in place to protect the loss, misuse, and alteration of the information under Triad ICC’s control. However, no security measures are guaranteed to be 100% effective and you should take appropriate precautions with respect to your data.

Cookies

“Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. The Triad ICC site uses cookies to keep track of your session, shopping cart, and advertising delivery. Triad ICC may also use cookies to deliver content specific to your interests and to save your password. Triad ICC may use an outside ad company to display ads on the Triad ICC site. These ads may also contain cookies. While Triad ICC uses cookies in other parts of its web site, cookies received with banner ads are collected by Triad ICC’s ad company.

We may use standard Internet technology, such as web beacons and other similar technologies, to track your use on our sites and software. We also may include web beacons in promotional e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the services we offer our users to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming or other activities.

We may allow third parties, including our authorized service providers, advertising companies, and ad networks, to display advertisements on our site and/or software. Triad ICC and these companies may use tracking technologies, such as cookies, to collect information about users who view or interact with these advertisements and connect to the Triad ICC properties and/or software. This information allows Triad ICC and these companies to deliver targeted advertisements and gauge their effectiveness.

We may use Google AdSense to publish ads on this site. When you view or click on an ad a cookie will be set to help better provide advertisements that may be of interest to you on this and other web sites. Our ad network partner also uses cookies and web beacons to collect information about your activities on this and other web sites to provide you targeted advertising based upon your interests. If you wish to not have this information used for targeting ads, you may opt-out. Please note this does not opt you out of being served advertising. You may opt-out of the use of this cookie or targeted advertising by visiting Google’s Advertising and Privacy page: http://www.google.com/privacy_ads.html.

Do Not Track Requests

Your web browser may have a setting that allows you to automatically send a “Do Not Track” message to the websites you visit. Triad ICC does not currently have technology to respond to such requests.

Other Information

We may collect, use and share information from your use of the website and/or services, provided such information is not subject to contractual commitments to the contrary, and it does not individually identify you or otherwise qualify as personal information, personal data, or similar, under an applicable law. Triad ICC shall have the right to retain records of all data pertaining to use of the website and applications including, but not limited to, usage, activity logs, and click-throughs. We may deidentify data in accordance with applicable laws and contractual commitments. We may disclose such data, whether collected or deidentified, to third parties provided it is grouped with other users’ data and is presented in an aggregate and deidentified form.

Links

Triad ICC may create links to other web sites. Triad ICC will make a reasonable effort to link only to appropriate sites but Triad ICC does not exercise control over the information, products, services or policies of third parties accessible through our site. This Privacy Policy does not apply to third party sites accessed via our site.

Many other sites that are not associated or authorized by Triad ICC may have links leading to our site. Triad ICC cannot control these links and Triad ICC is not responsible for any content appearing on these sites. This Privacy Policy does not apply to such third-party sites.

International Transfer of your Personal Information

The website and/or associated services is hosted and operated in the United States and is subject to United States law. Any personal information that we collect from you is currently stored and processed in the United States. If you are accessing the website and/or associated services outside of the U.S., you need to understand that by accessing our website and/or associated services, you consent to the transfer of your personal information to the United States. Please be advised that United States law may not offer the same privacy protections as the law in your jurisdiction.

Amendments

Triad ICC may amend this policy at any time. If Triad ICC is going to use personally identifiable information collected through the Triad ICC site in a manner materially different from that stated at the time of collection, Triad ICC will notify users via email and/or by posting a notice on the Triad ICC site for thirty (30) days prior to such use. This Privacy Policy may not be otherwise amended except in a writing that specifically refers to this Privacy Policy and is physically signed by both parties.

Successors and Assigns

This Privacy Policy inures to the benefit of successors and assigns of Triad ICC.

Opt-Out
